  1. SCOPE OF APPLICATION AND CONTRACTUAL RELATIONSHIP

1.1 These General Terms and Conditions (hereinafter “GTC”) apply to Christmas Garden events in Germany (“Events”). The organizer is Christmas Garden Deutschland GmbH, Potsdamer Str. 58, 10785 Berlin; Managing Directors: Sebastian Stein, Lutz Grotehöfer; Court of Registration: Charlottenburg Local Court (Berlin), HRB: 127606 (“Christmas Garden Deutschland”). These GTC form an integral part of the contract concluded between you (hereinafter “you” or “Customer”) and Christmas Garden Deutschland GmbH hereinafter “Christmas Garden Deutschland” or “Organizer”) regarding the purchase of admission tickets (hereinafter “Tickets”). The specific terms of this contract are governed by the following provisions. The sale of the tickets takes place in the name and on behalf of Christmas Garden Deutschland.

1.2 In addition to these Terms and Conditions, the terms and conditions (including the house rules) of the venue owner also apply at the respective event venue.

1.3 Any terms and conditions of the customer shall not form part of this contract, even if Christmas Garden Deutschland does not expressly object to them.

  1. TICKETS & COMPOSITION AND DUE DATE OF THE TICKET PRICE

2.1 Admission is granted only with a valid ticket. Please keep your ticket.

2.2 No replacements will be issued for lost tickets.

2.3 The ticket price consists of the current base ticket price, the advance-sale fee, the system fee, and, if applicable, any additional fees, each including applicable sales tax. The final ticket price may vary, particularly depending on the shipping method. You have the following options to choose from: (a) e-ticket: The ticket will be provided to you as a PDF. You can either display it digitally on your smartphone, print it out and bring the paper copy to the event, or save it to your Apple Wallet or Google Wallet. (b) Mail delivery: You select the standard shipping option, whereby we will send your order to you by mail. The final ticket price plus shipping costs will be displayed during the purchase process.

2.4 The ticket price is due immediately upon conclusion of the contract.

2.5 Discounted tickets for certain groups (e.g., schoolchildren, college students, seniors) are valid only upon presentation of appropriate proof of eligibility. If such proof cannot be provided, the difference between the discounted price and the full admission price must be paid.

  1. EXCLUSION OF THE RIGHT OF WITHDRAWAL / RETURN OF TICKETS AND REFUNDS

3.1 The contract for attending events is a contract for recreational events, under which customers do not have a statutory right of withdrawal. Therefore, by law, you cannot withdraw your declaration of intent regarding the purchase of tickets for recreational events.

3.2 As a general rule, the right to return tickets and receive a refund of the ticket price applies only if the entire event series is canceled. If it is not possible to hold the event on individual event days or on the specific event day and/or at the specific admission time that was booked (e.g., due to extreme weather conditions), the tickets remain valid for any subsequent day until the end of the event series. In this case, the ticket’s validity is no longer tied to a specific admission time. The ticket can be converted at the box office into a so-called “FlexTicket,” which entitles the holder to a one-time admission to the Christmas Garden with flexible selection of the day and time of visit within the opening hours until the end of the event series.

3.3 If the event is canceled or postponed due to circumstances beyond the organizer’s control (e.g., force majeure), the attendee may not cancel their ticket as long as a rescheduled or substitute event or an alternative date is offered within a reasonable timeframe. If the event is permanently canceled, the organizer will refund the ticket price paid; further claims are excluded in this case.

3.4 Fees paid are generally non-refundable. In the event that you withdraw from the event contract, we will offset our claim for compensation in the amount of the fees against your claim for a refund of the fees paid to us.

3.5 In each of the above cases, a refund of the respective ticket price will be issued only upon return of the original ticket; you are responsible for the associated costs. For digital tickets, the refund will be issued upon submission of the booking confirmation and tickets as a PDF via email to the respective ticket provider. Ticket refunds are not possible in the event of lost tickets.

3.6 By purchasing tickets, you acknowledge that we are required to enforce legal provisions and requirements regarding admission to the event (e.g., tests, digital or paper certificates, etc.). If at any time you fail to meet or comply with these regulations and requirements, we may—after an unsuccessful request for compliance—exercise our right to refuse entry and deny you access to the event or ask you to leave the event. A refund of the ticket price—even a partial one—is excluded in the aforementioned cases.

  1. CUSTOMER OBLIGATIONS WHEN ATTENDING AN EVENT

4.1 Admission to Christmas Garden events in Germany is only permitted during the specified entry times. When purchasing a ticket, you can select and book the available entry time. Admission is then only permitted within the specified 30-minute time slot. Admission before or after the booked time slot is therefore not guaranteed.

4.2 The duration of stay on the premises is limited to two hours. Visitors must leave the event grounds after two hours.

4.3. The organizer may impose specific rules of conduct on visitors and mandate certain measures (e.g., capacity limits, social distancing rules, designated routes or walking directions). Visitors agree to comply with these regulations.

4.4 Children up to and including five years of age are admitted free of charge.

4.5 Dogs and other animals are not permitted at the event venue (with the exception of Ehrenbreitstein Fortress, Mainau Island, and the Augsburg Zoo). The only exceptions are clearly identified, trained service dogs.

4.6 To protect the event venue and ensure peaceful coexistence among all visitors, the following is prohibited:
1. Leaving the paths or designated and illuminated event areas,
2. Removing, taking, or otherwise damaging plants or parts thereof,
3. to discard or leave behind waste of any kind outside the designated containers,
4. to light fires,
5. to climb on architectural or landscaping structures or sculptures,
6. to play ball games or other sports,
7. Holding demonstrations or gatherings,
8. Selling goods of any kind, offering services, distributing printed materials, conducting fundraisers, or staging artistic performances without the organizer’s permission, as well as advertising and distributing items of any kind.

4.7 The following items are prohibited on the event grounds:
1. Weapons of any kind,
2. Items and objects that can be used as weapons or projectiles (dangerous objects), laser pointers,
3. Hazardous and flammable substances (exception: standard pocket lighters), bottles, cups, mugs, cans, or other items made of breakable, shattering, or particularly hard material; bulky items such as ladders, boxes, suitcases, bicycles, pyrotechnic items, flags, or banners,
4. Mechanically operated noise-making devices or sound systems,
5. Food and beverages, with the exception of non-alcoholic beverages in PET bottles or Tetra Pak containers up to 1.5 L

4.8 You must follow the instructions of security personnel, the signs, and the announcements made over the loudspeaker.

4.9 Christmas Garden Germany reserves the right, in the event of a violation of the preceding paragraphs, to deny the customer in question or other individuals access to the event or to exclude them from the event.

  1. LIABILITY OF CHRISTMAS GARDEN GERMANY

5.1 Christmas Garden Deutschland shall be liable, without any limitation, for all damages to life, body, or health caused by its own fault within the scope of the contractual relationship. The same applies to all cases of mandatory statutory liability, in particular under the Product Liability Act, as well as in the event that a warranty is assumed.

5.2 In the event of a breach of material contractual obligations resulting solely from ordinary negligence and not covered by Section 5.1, Christmas Garden Deutschland’s liability is limited to compensation for foreseeable damages typical for this type of contract. The material contractual obligations of Christmas Garden Deutschland include those obligations whose fulfillment is essential for the proper performance of the contract and on whose compliance you may reasonably rely.

5.3 In all other respects, Christmas Garden Deutschland shall be liable only in the event of a breach of contractual obligations resulting from gross negligence or willful misconduct.

5.4 To the extent that Christmas Garden Deutschland’s liability is excluded or limited pursuant to the preceding paragraphs, this also applies to the liability of its legal representatives and agents.

5.5 You and your companions are aware that, despite all precautions, the risk of infection—for example, with the COVID-19 virus or other infectious diseases—cannot be completely ruled out. By purchasing a ticket and attending the event, you and your companions expressly accept this risk as part of the general risks of life.

  1. PHOTOGRAPHS AND/OR VIDEO RECORDINGS TAKEN BY VISITORS

6.1 Taking photos and/or recording videos at the respective event venues is permitted only on the condition that they are used solely for personal, non-commercial purposes.

6.2 All rights to photographs and video recordings of the event for commercial use are exclusively held by Christmas Garden Deutschland GmbH. No one may record, broadcast, and/or make Christmas Garden Deutschland GmbH recordings publicly available for commercial purposes without the prior written consent of Christmas Garden Deutschland GmbH . This includes, in particular, the distribution of such recordings directly via the Internet.

  1. AUDIO AND/OR VIDEO RECORDINGS FROM CHRISTMAS GARDEN GERMANY

In the event that, during the event, video and/or audio recordings—such as radio or television broadcasts—are made by authorized persons and you are recognizably captured in the video and/or audio, you hereby implicitly agree that the recordings may be reproduced, distributed, and publicly performed—in particular, broadcast—without any claim to compensation, provided that this does not conflict with your legitimate interests.

  1. GOVERNING LAW, JURISDICTION

8.1 The contract, including the manner in which it was concluded, as well as all rights and obligations arising therefrom, shall be governed by German law. To the extent that the customer is not a consumer, German law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

8.2 The place of performance and venue shall be Berlin, provided that the customer is a merchant, a legal entity under public law, or a special fund under public law.

8.3 If the customer is a consumer and purchased the ticket online, the organizer notes that it is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 of the VSBG). 

  1. FINAL PROVISIONS

Should any provision of this contract be or become wholly or partially void or invalid, this shall not affect the validity of the remaining provisions. The statutory provision (§ 306(2) BGB) shall replace any General Terms and Conditions that are not incorporated or are invalid. Furthermore, the parties shall replace the void or invalid provision with a valid provision that comes as close as possible to its economic purpose, unless a supplementary interpretation of the contract takes precedence.
