Terms and conditions of participation

Participation in the competition requires acceptance of the terms and conditions. By participating in the competition, the participant accepts these terms and conditions. Christmas Garden Deutschland GmbH the right to exclude participants from the competition in the event of a violation of these terms and conditions.

1. Organizer
The organizer of this competition is Christmas Garden Deutschland GmbH, Potsdamer Str. 58, 10785 Berlin.

2. Eligibility to participate
Persons residing in Germany who are at least 18 years of age at the time of participation are eligible to participate. Employees of Christmas Garden Deutschland GmbH, DEAG Deutsche Entertainment AG, their relatives, and other persons involved in the conception and implementation of this competition are excluded from participation. The participant in the competition is the person who owns the Instagram account used to enter the competition. Participation is free of charge and independent of the purchase of goods or services. By participating in the competition, the user accepts these terms and conditions.

3. Participation
Participation is possible with a personal Instagram account. The prerequisite for participation is the publication of a picture on Instagram under the hashtag #ilovechristmasgarden and the linking of the official Christmas Garden account (@christmasgarden_official). Regardless of the number of accounts, a person can only participate in the photo contest once, regardless of the number of activities that person has in relation to the photo contest. Participants can enter by posting a photo from a Christmas Garden 2025 with the hashtag #ilovechristmasgarden on their publicly visible Instagram account.

The contest period is limited to November 13, 2025, through January 12, 2026. The deadline for entries is January 12, 2026, at 11:59 p.m.

4th prize
The grand prize (1st place) is a trip to Barcelona on one of the Advent weekends in 2026, including round-trip flights (economy class), one night's accommodation in a 4-star hotel with breakfast, and admission to Christmas Garden Barcelona 2026 (event name: Els Llums de Sant Pau) for two people. Additional transportation and meal costs are not included.
The prizes for 2nd to 5th place are: 2 tickets each for Christmas Garden 2026.

All winners will be selected at random (by lottery) between January 19, 2026, and February 19, 2026.

If the prize is not available, in particular due to the fact that a Christmas Garden cannot take place for any reason, Christmas Garden Deutschland GmbH reserves Christmas Garden Deutschland GmbH right to replace the prize with an equivalent alternative. Cash payment of the prize value is excluded.

5. Determination of winners and notification
The winner of the competition will be determined Christmas Garden Deutschland GmbH random ( Christmas Garden Deutschland GmbH lottery) from among all participants by Christmas Garden Deutschland GmbH . Cash payment of the value of the prize or exchange of the prize is not possible. The prize is non-transferable. The winner of the prize will be notified promptly by email. In this context, the winner will be provided with all necessary and relevant information free of charge. For the sake of clarity, it should be noted that Christmas Garden Deutschland GmbH will Christmas Garden Deutschland GmbH bear the direct costs associated with the prize. 6. Early termination
Christmas Garden Deutschland GmbH the right to terminate or interrupt the competition at any time, particularly in the event of malfunctions, disruptions, forgeries, viruses, or similar serious damage that fundamentally impairs the administration, security, fairness, integrity, or running of the competition. No claims can be derived from early termination.

7. Data protection
We process personal data (hereinafter also referred to as "data") of participants in competitions only in compliance with the relevant data protection regulations, insofar as the processing is necessary for the provision, implementation, and handling of the competition (Art. 6 (1) (b) GDPR), the participants have consented to the processing (Art. 6 (1) (a) GDPR), or the processing serves our legitimate interests in the security of the competition or in protecting our interests from misuse in accordance with Art. 6 (1) (f) GDPR.

Participants' data will only be transferred to other parties if this is necessary for the purpose of conducting the competition (e.g. for sending prizes or to technical service providers commissioned in connection with the competition) or if a participant has consented to the transfer (see No. 7).

We inform participants in the competition which of their details are required for participation.

Participants' data will be deleted as soon as the competition has ended and the data is no longer required to inform the winners or because queries about the competition are to be expected. Furthermore, participants' data may be stored for longer, e.g. in the context of (data protection-compliant) reporting on the competition in online and offline media or in the case of participation contributions that are published on social media.

The data stored by us as part of your consent for the purpose of the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers after you unsubscribe. Data stored by us for other purposes (e.g., email addresses for the member area) remains unaffected by this.

As data subjects under the GDPR, participants are entitled to various rights, which arise in particular from Articles 15 to 21 GDPR:

8. Final provisions
By participating in the competition, the participant confirms that he/she has read and agrees to these terms and conditions. Legal recourse is excluded. Any liability for damages on the part of Christmas Garden Deutschland GmbH its organs, employees, and vicarious agents arising from or in connection with the competition, regardless of the legal basis, is limited to cases of intent or gross negligence. The above does not apply in the event of damage resulting from injury to life, limb, or health. Christmas Garden Deutschland GmbH to change or correct these terms and conditions for good cause. Should individual provisions of the terms and conditions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected.
The terms and conditions of participation and participation itself are subject to the laws of the Federal Republic of Germany.
