Terms and Conditions of Participation

Participation in the contest requires acceptance of the terms and conditions. By participating in the contest, the participant accepts these terms and conditions. Christmas Garden Deutschland GmbH the right to exclude participants from the contest in the event of a violation of these terms and conditions.

1. Organizer
. The organizer of this sweepstakes is Christmas Garden Deutschland GmbH, Potsdamer Str. 58, 10785 Berlin.

2. Eligibility
Eligible to participate are individuals residing in Germany who are at least 18 years old at the time of entry. Employees of Christmas Garden Deutschland GmbH and DEAG Deutsche Entertainment AG, their relatives, and other individuals involved in the design and implementation of this contest are excluded from participation. The participant in the contest is the person who owns the Instagram account used to enter the contest. Participation is free of charge and not contingent upon the purchase of any goods or services. By participating in the contest, the user accepts these terms and conditions.

3. Participation
Participation is possible using your personal Instagram account. To participate, you must post a photo on Instagram using the hashtag #ilovechristmasgarden and tag the official Christmas Garden account (@christmasgarden_official). Regardless of the number of accounts a person has, each person may enter the photo contest only once, regardless of the number of activities that person undertakes in connection with the photo contest. To enter, participants must post a photo from a Christmas Garden 2025 with the hashtag #ilovechristmasgarden on their public Instagram account.

The contest period runs from November 13, 2025, through January 12, 2026. The deadline for entries is January 12, 2026, at 11:59 p.m.

4. Prize:
The grand prize (1st place) is: A trip to Barcelona on one of the Advent weekends in 2026, including round-trip airfare (in Economy Class), one night’s stay at a 4-star hotel with breakfast, and admission to the Christmas Garden Barcelona 2026 (event name: Els Llums de Sant Pau) for two people. Additional transportation and meal costs are not included.
The prizes for 2nd through 5th place are: 2 tickets each to the Christmas Garden 2026

All winners will be selected at random (by lottery) between January 19, 2026, and February 19, 2026.

If the prize is not available—particularly if a Christmas Garden event cannot take place for any reason— Christmas Garden Deutschland GmbH reserves Christmas Garden Deutschland GmbH right to replace the prize with an alternative of equal value. Cash payment of the prize value is not permitted.

5. Determination of the Winner and Notification
The winner of the contest will be selected Christmas Garden Deutschland GmbH random ( Christmas Garden Deutschland GmbH lottery) from among all participants by Christmas Garden Deutschland GmbH . The prize cannot be redeemed for cash, nor can it be exchanged for another item. The prize is non-transferable. The winner will be notified promptly via email. In this context, the winner will be provided with all necessary and relevant information free of charge. For clarification purposes, it should be noted that Christmas Garden Deutschland GmbH will Christmas Garden Deutschland GmbH cover the direct costs associated with the prize. The winner must confirm receipt of the prize notification Christmas Garden Deutschland GmbH immediately, but no later than 72 hours after the announcement, and provide the personal information Christmas Garden Deutschland GmbH by Christmas Garden Deutschland GmbH . Otherwise, Christmas Garden Deutschland GmbH is Christmas Garden Deutschland GmbH to select a new winner; the original winner will then no longer be entitled to claim the prize.

6. Early Termination
Christmas Garden Deutschland GmbH the right to terminate or suspend the contest at any time, particularly in the event of malfunctions, disruptions, fraud, viruses, or similar serious issues that fundamentally impair the administration, security, fairness, integrity, or conduct of the contest. No claims may be derived from early termination.

7. Data Protection
We process personal data (hereinafter also referred to as “data”) of contest participants only in compliance with the relevant data protection regulations, to the extent that such processing is necessary for the provision, conduct, and administration of the contest (Art. 6(1), sentence 1, subparagraph b. GDPR), the participants have consented to the processing (Art. 6(1), sentence 1, lit. a GDPR), or the processing serves our legitimate interests in the security of the contest or in the protection of our interests against misuse pursuant to Art. 6(1), sentence 1, lit. f GDPR.

Participants’ data will only be disclosed to third parties if this is necessary for the conduct of the sweepstakes (e.g., to ship prizes or to technical service providers contracted in connection with the sweepstakes) or if a participant has consented to such disclosure (see No. 7).

As part of the sweepstakes, we inform participants which of their details are required for entry.

Participants’ data will be deleted as soon as the contest has ended and the data is no longer needed to notify the winners or to address any questions regarding the contest. Furthermore, participants’ data may be stored for a longer period, e.g., as part of (data protection-compliant) reporting on the contest in online and offline media, or in the case of contest entries that are published on social media.

The data we have stored about you as part of your consent to receive the newsletter will be retained by us until you unsubscribe from the newsletter and will be deleted from our servers once you unsubscribe. Data that we have stored for other purposes (e.g., email addresses for the members-only area) remains unaffected by this.

As data subjects under the GDPR, participants are entitled to various rights, which arise in particular from Articles 15 through 21 of the GDPR:

• Right to Rectification under Article 16 of the GDPR
• Right to erasure pursuant to Article 17 of the GDPR
• Right to Restriction of Processing under Article 18 of the GDPR

8. Final Provisions
By participating in the contest, the participant confirms that he or she has read and agrees to these Terms and Conditions. Legal recourse is excluded. Any liability for damages on the part of Christmas Garden Deutschland GmbH its officers, employees, and agents arising from or in connection with the contest, regardless of the legal basis, is limited to cases of willful misconduct or gross negligence. The foregoing does not apply in the event of damages resulting from injury to life, limb, or health. Christmas Garden Deutschland GmbH to amend or correct these Terms and Conditions for good cause. Should individual provisions of the Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
The Terms and Conditions, as well as participation itself, are governed by the laws of the Federal Republic of Germany.
