Photo competition

Conditions of participation

Participation in the competition requires acceptance of the conditions of participation. By participating in the competition, the participant accepts these conditions of participation. Christmas Garden Deutschland GmbH reserves the right to exclude participants from the competition if these conditions of participation are breached.

1. organizer
The organizer of this competition is Christmas Garden Deutschland GmbH, Potsdamer Str. 58, 10785 Berlin.

2. eligibility
Eligible to participate are persons residing in Germany who are at least 18 years old at the time of participation. Employees of Christmas Garden Deutschland GmbH, DEAG Deutsche Entertainment AG, their relatives and other persons involved in the conception and implementation of this competition are excluded from participation. The participant in the competition is the person who is the owner of the Instagram account used to take part in the competition. Participation is free of charge and independent of the purchase of goods or services. By participating in the competition, the user accepts these conditions of participation.

3. participation
Participation is possible with the personal Instagram account. The prerequisite for participation is the publication of a picture on Instagram under the hashtag #ilovechristmasgarden. Regardless of the number of accounts, a person can only take part in the photo competition once, regardless of the number of activities of this person with regard to the photo competition. Participants can take part by posting a photo from a Christmas Garden 2024 with the hashtag #ilovechristmasgarden on their publicly visible Instagram account.

The competition period is limited to November 14, 2024 to January 12, 2025. The closing date for entries is January 12, 2025, 11:59 p.m.

4th prize
The main prize (1st place) is: A trip to Barcelona on one of the Advent weekends in 2025 including return flights (in economy class), an overnight stay in a 4-star hotel including breakfast and admission to the Christmas Garden Barcelona 2025 (name of the event: Els Llums de Sant Pau) for two people. Further transportation and catering costs are not included.
The 2nd to 5th place prizes are: 2 tickets each for the Christmas Garden 2025
If the prize is not available, in particular because an event of Christmas Garden Deutschland GmbH or the event Els Llums de Sant Pau 2025 cannot take place for any reason, Christmas Garden Deutschland GmbH reserves the right to replace the prize with an alternative of equal value. Payment of the prize value is excluded.

All winners will be selected at random (by drawing lots) in the period from January 17, 2025 to February 17, 2025 .

If the prize is not available, in particular due to the fact that a Christmas Garden cannot take place for any reason, Christmas Garden Deutschland GmbH reserves the right to replace the prize with an alternative of equal value. Payment of the prize value is excluded.

5. determination of the winner and notification
The winner of the competition will be chosen at random from all participants by Christmas Garden Deutschland GmbH (drawing of lots). Cash payment of the prize or exchange of the prize is not possible. The prize is non-transferable. The winner of the prize will be notified promptly by e-mail. In this context, the winner will be provided with all necessary and relevant information free of charge. For the sake of clarification, it should be noted that Christmas Garden Deutschland GmbH will only bear the direct costs relating to the prize. The winner must confirm receipt of the prize notification to Christmas Garden Deutschland GmbH without delay, but no later than 72 hours after notification, and provide the personal details required by Christmas Garden Deutschland GmbH . Otherwise, Christmas Garden Deutschland GmbH is entitled to select a new winner; the previous winner can then no longer claim the prize.

6. premature termination
Christmas Garden Deutschland GmbH has the right to terminate or interrupt the competition at any time, in particular if malfunctions, faults, forgeries, viruses or similar serious damage occur and fundamentally impair the administration, security, fairness, integrity or running of the competition. No claims can be derived from premature termination.

7. data protection
We process personal data (hereinafter also referred to as "data") of participants in competitions only in compliance with the relevant data protection regulations, insofar as the processing is necessary for the provision, implementation and handling of the competition (Art. 6 para. 1 sentence 1 lit. b. GDPR), the participants have consented to the processing (Art. 6 para. 1 sentence 1 lit. a GDPR) or the processing pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR serves our legitimate interests in the security of the competition or in protecting our interests against misuse.

Participants' data will only be transmitted to other bodies if this is necessary for the implementation of the competition (e.g. for sending prizes or to technical service providers commissioned in connection with the implementation) or if a participant has consented to the transmission (see no. 7).

As part of the competition, we inform participants which of their details are required for participation.

The participants' data will be deleted as soon as the competition has ended and the data is no longer required to inform the winners or because queries about the competition are to be expected. Furthermore, participants' data may be stored for longer, e.g. as part of (data protection-compliant) reporting on the competition in online and offline media or in the case of entries published on social media.

The data stored by us as part of your consent for the purpose of the newsletter will be stored by us until you unsubscribe from the newsletter and will be deleted from our servers after you unsubscribe from the newsletter. Data stored by us for other purposes (e.g. e-mail addresses for the member area) remain unaffected by this.

As data subjects, participants are entitled to various rights under the GDPR, which arise in particular from Art. 15 to 21 GDPR:

• Right to restriction of processing pursuant to Art. 18 GDPR

8. final provisions
By participating in the competition, the participant confirms that he/she has taken note of these conditions of participation and agrees to them. Legal recourse is excluded. Any liability for damages on the part of Christmas Garden Deutschland GmbH and its bodies, employees and vicarious agents arising from or in connection with the competition, irrespective of the legal grounds, is limited to cases of intent or gross negligence. The above does not apply in the case of damages resulting from injury to life, body or health. Christmas Garden Deutschland GmbH reserves the right to amend or correct these conditions of participation for justified reasons. Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
The conditions of participation and the participation itself are subject to the law of the Federal Republic of Germany.
